Case decisions

The Decision section of a law report is often referred to as the Judgment section for ORIL law reports and the Award or Decision section for Investment Claims law reports.

Where a decision file only becomes available after you have captured the headnote, OUP return the XML to you with the decision for you to update.

For Investment Claims cases, tribunals can make decisions that cover several claims, therefore several headnotes can share the same decision. The grey box at the top of the template gives the name of the headnotes covered by the decision. Capture the decision once, and copy the judgmentGrp element to each headnote for a claim covered by the decision.

  1. What to capture from a decision

    Capture the entire text of the decision including the names of the arbitrators or judges giving the decision. Do not capture preliminary text.

  2. Capturing images for decisions

    For decisions, provide images in two sizes and place in two separate folders. Use the same file name, format and extension for both versions of each image.

  3. Decision translation status

    Capture the translation status from the filename in the type attribute.

  4. Decision language

    Use the xml:lang attribute to specify the language of the decision. Its value is the three-letter ISO code (ISO 639-2) for the language.

  5. Roman and non-roman decision files

    Convert roman text decisions to XML. For non-roman text decisions, convert the headnote to XML and capture a file reference to a PDF file of the decision.

  6. Table of contents in decisions

    Where a decision includes a table of contents, capture it as a list within a first div1 child of textMatter. Do not capture page numbers.

  7. Arbitrators or judges in decisions

    Capture a full decision by a single arbitrator or judge within one div1. For files containing the decisions of more than one arbitrator or judge, each decision is identified by the arbitrator or judge name as a header.

  8. Number paragraphs in decisions

    Within a decision, capture each conceptual paragraph in a new p element. Also add or capture numbering in enumerators.

  9. Partial translations

    On occasion OUP commissions a translation of part of the judgment. This is often after the original headnote and judgment has been converted to XML.

  10. Undisclosed or redacted text in decisions

    Certain items of text in a judgment may appear redacted, blanked or blacked out. Capture these items as the plain text [undisclosed].

  11. Float groups in decisions (figures, tables, media or boxed-matter)

  12. Footnotes to decisions

    Capture footnotes outside the normal flow of text, in noteGroup elements. In a note element with attribute type="footnote".

  13. External PDF Files in Cases

    Capture external PDF files as an attribute of the child fileRef element.
